What is REACh?

 

REACh is the new EU chemicals regulation which came into force on 01.06.2007. It sets out the provisions for manufacturing chemicals, placing them on the market and their usage.

 

What obligations have to be fulfilled by the individual actors affected by REACh?

 

The obligations placed on the REACh actors - manufacturers, importers and downstream users - vary. They span a wide range covering (pre-) registration, communication in the supply chain and carrying out risk management measures

 

What demands are the individual actors affected by REACh facing?

 

Differing demands are associated with the various obligations placed on the individual actors in the supply chain. For example, manufacturers and importers are required to compile a registration dossier. Communication within the supply chain is ensured, for example, by every prior actor in the supply chain providing the downstream users with information on the safe handling of a substance.

 

What potential risks are associated with REACh?

 

Without the required registration substances may neither by produced nor placed on the market. This may lead to manufacturers and importers - but also traders and downstream users - being restricted in their actions. The introduction of the REACh Regulation confronts the REACh actors with requirements that have to be fulfilled in order to comply with the law. An infringement of a commitment may lead to a fine or constitute a criminal offence - depending on the severity.

 

What effects may be linked to REACh?

 

The effects of REACh may considerably vary. Manufacturers and importers are faced with increased financial, time and labour expense. This may lead to increased costs for certain substances and / or may effect the availability of the substance. Downstream users, therefore, may find themselves confronted with higher raw material prices and, among other things, with the situation that some substances may no longer be available, or only available in limited quantities, on the European market. This may have far-reaching consequences, e.g. on product and process quality.

 

What preparations does REACh entail?

 

An inventory survey should be carried out to identify which products a company uses and which substances they contain. These then have to be checked as to their REACh relevance. In addition, the role(s) the company has to accept for each individual substance must be identified.

 

Why is Pre-Registration necessary?

 

In line with the principle: “No data - no market” only those substances may be produced, placed on the market or used for which information on the risks they present to humans and/or the environment, as well as on measures for controlling these risks, is available. To this end, registration is required for certain substances. This entails submitting a registration dossier containing information on the physical and chemical characteristics, the toxicity, the ecotoxicity as well as risk management measures to the ECHA.
